Benefitting from this amnesty are mainly foreigners who haven’t extended their residence visa on time which was fined with 1 UIT (in 2023 that’s S/ 49.50) per day being late, but as well those who haven’t updated their information in the Migraciones database within 30 days, haven’t renewed their carné before expiration and have carried out activities not corresponding to their immigration status.

The amnesty as well applies to foreigners who have already agreed on an installment plan with Migraciones or are paying installments. However, it is unclear at this moment if those who have already paid their fine completely can get a refund.

Please be aware that the amnesty does not apply to tourists in Peru, who have overstayed.

To be granted amnesty, you must apply for it. And the amnesty only exempts you from paying the fine. After you received the resolution granting you amnesty, you immediately must, for example, apply for the extension of your residence visa, update your information or apply for a new carné.

According to the law 31732, the amnesty is only granted for the next 6 months. So, you only have until the end of October 2023 to apply for it.
